Expert Elder Law & Estate Planning Services in Melville, NY

Ettinger Law Firm was founded in 1991 and has multiple offices throughout New York State including three office locations in Suffolk County. Principal attorney Michael Ettinger’s approach to estate planning includes a strong elder law component. Planning for potential disability, he believes, may be more essential than the equitable distribution of assets. New clients receive a combined elder law estate planning approach that is unique in today’s world. As he often says, “in today’s environment, planning for disability is more important than planning for death.”

Discover the Area Around Our Suffolk County Offices

We chose Suffolk County as one of our prime office locations because we love the area as much as you do. Many New Yorkers use the expression “out on the Island” when referring to Suffolk County, one of the most diverse regions in the state with its range in income, education and demographics. With a population of more than 8 million people, Long Island is the most populated island in any U.S. state or territory and it is also the longest and largest island in the contiguous United States.

A brief description of this Long Island County would not be complete without mention of the Poospatuck and Shinnecock Native Americans who have been a part of the population for thousands of years. Part of the Algonquin-speaking people, the tribe’s land base is within the geographic boundaries of the Town of Southampton.

Suffolk County is part of the 10th Judicial District of the New York State Unified Court System, and its Surrogate’s Court hears cases for decedent affairs, will probate, estate administration, guardianships and adoptions.

Estate Planning, Administration and Probate

Your estate comprises everything you own, and estate planning is the best way to ensure every asset is accounted and planned for in the event of your death. It includes material items like homes and antiques, financial accounts like your bank account and any trusts or wills you may have established.

From the moment you create your plan until every wish on it has been followed, Ettinger Law Firm will champion its importance to your loved ones and the court, if necessary.

Medicaid is a critical part of many older adults’ financial planning, especially as they consider long-term care expenses such as home care or living at a nursing home. You must meet and stay within certain eligibility requirements to continue qualifying for these critical services, and Ettinger Law Firm will make sure you understand and follow through as necessary.

A will is one of the most common ways people organize and distribute their assets following their death. Our legal team will walk you through the benefits of a will and other options available so you can make the right choice for your situation.

Frequently Asked Questions

For Melville families, the choice between a will and trust depends on your situation. Wills are straightforward but lead to probate—a lengthy, public court process that delays asset distribution and adds expense. Trusts avoid probate, maintain privacy, and allow immediate asset management if you become incapacitated. Many Melville residents benefit from a hybrid approach: a trust for most assets and a back up/pour-over will for any items not in the trust. Our Melville office explains the practical implications so you can decide with confidence.

Melville-area clients access our comprehensive elder law and estate planning services: Revocable and Irrevocable Trusts designed for Suffolk County families; Medicaid Asset Protection Trusts to shield family assets from long-term care costs; detailed Wills and Probate Administration; Powers of Attorney granting financial authority to trusted individuals; Healthcare Proxies and Living Wills honoring your medical wishes; Special Needs Trusts for disabled beneficiaries; Estate Tax Planning for tax-efficient wealth transfer; and Inheritance Protection Trusts safeguarding inheritances. We understand the Melville business community and serve entrepreneurs, professionals, and retirees. Our Lifetime Estate Planning Process ensures plans stay current with your life and the law—free reviews every three years.

Medicaid planning is core to our practice in Melville. We help families understand how to qualify for Medicaid benefits while protecting assets they want to preserve. We establish Medicaid Asset Protection Trusts years before care is needed; navigate complex Medicaid applications when care becomes urgent; explain the five-year look-back rule and transfer penalties; and structure assets according to New York law. We also discuss planning for Community Medicaid (home care aides) and Chronic Care Medicaid (nursing facilities). With thousands of successful cases and 35+ years of experience, our Melville office brings practical knowledge to help families make informed decisions.

Scheduling is easy—call our Melville office at (631) 673-3777 or our main number at 1-800-500-2525. You can also start online at trustlaw.com. Your free first consultation includes: thorough review of your current estate documents; detailed discussion of your assets, family situation, and planning goals; comprehensive answers to your estate planning questions; a complimentary copy of our “Guide to Protecting Your Future”; and access to our educational video on trust strategies. We follow up with a second free consultation 2–3 weeks later to go over recommendations and provide a written fee proposal. No obligation, no cost until you’re completely satisfied.

Our Melville office is located in the Huntington Quadrangle business complex at 1 Huntington Quadrangle, Suite #1N9, Melville, NY 11747. Once parked in the north end of the lot – our office is in the North Lobby of Quadrangle 1, on the first floor. If you need an accessible path into the building/to avoid stairs, there is a red-brick garden path that leads from the crosswalk at the accessible parking spaces towards the middle of the building. Following the path towards the middle of the building is a little shorter and will lead to the Center Lobby doors – if you enter this way, turn right, and we are just behind the North Lobby sign. Following the other branch of the path will be a longer walk, but will have occasional seating built into the wall, and will lead to the North Lobby Doors – we will be just past the elevator from this direction. The shortest access from the parking is to follow the sidewalk, not the brick path, past the gates to the covered entry, though this route does require stairs. Hours are Monday–Thursday 9:00 AM – 5:00 PM and Friday 9:00 AM – 1:00 PM. If you’re unfamiliar with the location, call (631) 673-3777 for directions.
